Welcome to Possibl.

Possibl is a talent discovery and booking platform that helps people discover, connect with and book talented creators, artists, coaches, instructors, professionals, studios, events, classes, experiences and other talent-related services.

These Terms & Conditions (“Terms”) govern your access to and use of the Possibl website, web application, and, when made available, our mobile applications and related services (collectively, the “Platform” or “Service”).

By accessing, registering for, browsing or using Possibl, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Platform.

1. About Possibl

Possibl is operated as a digital platform that facilitates the discovery, connection and booking of talent and talent-related services.

Depending on the particular service, Possibl may act as a platform connecting users with independent talents, creators, professionals, studios, organizers or other service providers.

Unless expressly stated otherwise, Possibl is not the creator, instructor, artist, professional, studio, event organizer or service provider offering a particular service through the Platform.

The actual service is generally provided by the applicable talent, creator, professional, studio, organizer or other service provider (“Service Provider”).

Possibl's role may include providing technology, discovery, profiles, search, communication, booking, payment facilitation, reviews, recommendations and other platform functionality.

2. Eligibility

You must be legally capable of entering into a binding agreement to use Possibl.

If you are under the age required to independently enter into contracts under applicable law, you may use Possibl only with the involvement, supervision or consent of a parent, legal guardian or other authorized adult where required.

Certain services, bookings or experiences may have additional age requirements.

Service Providers are responsible for ensuring that their services are offered only to users who meet any applicable age, eligibility or participation requirements.

3. Creating an Account

Some features of Possibl may require you to create an account.

You agree to:

  • Provide accurate and current information
  • Keep your account information updated
  • Maintain the confidentiality of your login credentials
  • Not share your account with another person
  • Not impersonate another person or organization
  • Not create accounts for fraudulent or deceptive purposes
  • Notify Possibl if you believe your account has been compromised

You are responsible for activity occurring through your account unless the activity resulted from circumstances for which you are not reasonably responsible.

Possibl reserves the right to suspend or restrict accounts containing inaccurate, misleading, fraudulent or otherwise prohibited information.

4. Using Possibl as a Consumer

Possibl allows users to discover and potentially book talent, creators, professionals, studios, classes, events, sessions and experiences.

You may:

  • Search and discover Service Providers
  • View profiles and portfolios
  • Save or follow relevant content or profiles where functionality is available
  • Contact or interact with Service Providers through available Platform features
  • Request or make bookings
  • Make payments where supported
  • Leave reviews or ratings following eligible interactions
  • Use other features made available by Possibl

You agree to use the Platform only for legitimate purposes and in accordance with these Terms.

5. Using Possibl as a Talent, Creator or Service Provider

Possibl may allow talented individuals, creators, artists, instructors, coaches, professionals, studios, organizers and other eligible providers to create profiles and offer services through the Platform.

If you register as a Service Provider, you agree that:

  • Your profile information is accurate and not misleading
  • You have the legal right and authority to offer the services you list
  • You have the necessary qualifications, permissions, licenses or certifications where applicable
  • Your pricing and availability are accurate
  • You will honor confirmed bookings
  • You will provide services professionally and safely
  • You will communicate honestly with customers
  • You will comply with applicable laws and regulations
  • You will not use Possibl to offer prohibited or unlawful services
  • You will not upload content that infringes another person's rights

Service Providers are responsible for the services they offer, including their quality, safety, qualifications, availability, pricing, delivery and compliance with applicable laws.

Possibl does not guarantee that any Service Provider will receive bookings, customers, revenue or a particular level of visibility.

6. Profiles, Portfolios and Public Information

Possibl allows Service Providers to create profiles that may include:

  • Name
  • Profile photograph
  • Biography
  • Skills and areas of expertise
  • Services or sessions
  • Pricing
  • Availability
  • Location
  • Photos
  • Videos
  • Portfolio material
  • Social media links
  • Reviews and ratings
  • Other information provided by the Service Provider

Some profile information may be publicly visible or discoverable through search engines or other services.

You should only publish information that you have the right to publish and that you are comfortable making publicly available.

Possibl may display, organize, rank or recommend profiles and content based on factors such as relevance, location, availability, popularity, quality signals, user interactions and other platform considerations.

7. Bookings

Where booking functionality is available, users may request or confirm bookings for services offered by Service Providers.

A booking may be subject to:

  • Availability
  • Service Provider acceptance
  • Pricing
  • Booking conditions
  • Payment requirements
  • Cancellation policies
  • Minimum or maximum participation requirements
  • Other conditions displayed at the time of booking

A booking is considered confirmed only when the Platform indicates that the booking has been successfully confirmed.

Possibl does not guarantee that every booking request will be accepted or fulfilled.

8. Payments

Where payments are enabled through Possibl, payments may be processed through third-party payment providers.

You agree to provide accurate payment and billing information when required.

Prices displayed on the Platform may include or exclude applicable taxes, fees or other charges depending on the specific service and applicable law.

The final amount payable will be the amount displayed during the applicable checkout or booking process.

Possibl may charge platform fees, booking fees, subscription fees, commissions or other charges where clearly disclosed to the relevant user or Service Provider.

Payment processing may be subject to the terms and privacy policies of the applicable payment provider.

9. Cancellations, Refunds and Rescheduling

Cancellation, refund and rescheduling terms may vary depending on the Service Provider and the specific service.

The applicable cancellation or refund policy should be displayed or communicated during the booking process where applicable.

Where Possibl processes or facilitates a refund, the refund will generally be handled according to the applicable booking policy and payment provider's processing timelines.

Possibl may assist with disputes or booking issues but does not guarantee a particular outcome unless expressly stated.

Service Providers must honor their stated cancellation, refund and rescheduling policies and applicable consumer protection requirements.

10. Service Provider Responsibility

Service Providers are independent providers unless expressly identified otherwise.

A Service Provider is responsible for:

  • The accuracy of their profile
  • The legality of their services
  • Their qualifications and credentials
  • The quality of their services
  • Their conduct toward users
  • Safety during their services
  • Compliance with applicable laws
  • Required permissions, licenses and registrations
  • Their tax and financial obligations
  • Their cancellation and refund obligations
  • Content uploaded to their profile

Possibl does not guarantee the quality, suitability, legality, availability, qualifications or performance of any Service Provider.

Users should independently evaluate a Service Provider before making a booking.

11. Reviews and Ratings

Possibl may allow users to submit reviews, ratings and feedback about their experiences.

Reviews should be:

  • Honest
  • Relevant
  • Based on an actual interaction or booking
  • Free from harassment, threats or abusive language
  • Free from fraudulent or manipulated content
  • Free from discriminatory or unlawful content

You must not:

  • Submit fake reviews
  • Review yourself or your own services deceptively
  • Pay or incentivize someone to submit a misleading review
  • Manipulate ratings
  • Threaten someone to obtain a favorable review
  • Use reviews to harass or defame another person

Possibl may remove or restrict reviews that violate these Terms or applicable policies.

12. User Content

Users and Service Providers may upload or submit content including photographs, videos, descriptions, reviews, comments, profiles, portfolios and other materials (“User Content”).

You retain ownership of User Content that you own.

However, by uploading User Content to Possibl, you grant Possibl a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, adapt, format and otherwise use that content as reasonably necessary to operate, provide, promote and improve the Platform.

This license continues for as long as reasonably necessary for the relevant purposes, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights and permissions to submit the User Content.

13. Intellectual Property

Possibl and its underlying technology, software, design, user interface, branding, logos, trademarks, graphics, databases, content and other intellectual property are owned by or licensed to Possibl and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

  • Copy or reproduce the Platform
  • Reverse engineer or attempt to extract source code
  • Modify or create derivative versions of the Platform
  • Reproduce Possibl branding without permission
  • Use Possibl trademarks without authorization
  • Scrape or systematically collect Platform data
  • Sell, redistribute or commercially exploit Platform content without authorization
  • Circvent technical restrictions or security measures

Nothing in these Terms transfers ownership of Possibl's intellectual property to you.

14. Acceptable Use

You agree not to use Possibl to:

  • Break or violate applicable laws
  • Commit fraud or facilitate fraudulent activity
  • Impersonate another person
  • Create misleading profiles
  • Harass, threaten or abuse another person
  • Discriminate against another person unlawfully
  • Upload malware or malicious code
  • Attempt unauthorized access to accounts or systems
  • Scrape or automate access to the Platform without authorization
  • Manipulate rankings, reviews or engagement
  • Circumvent booking or payment systems
  • Use the Platform for spam
  • Promote illegal activities
  • Offer prohibited services
  • Upload sexually explicit, exploitative or otherwise prohibited material
  • Infringe copyright, trademark, privacy, publicity or other rights
  • Use Possibl to collect personal information for unauthorized purposes

Possibl may remove content, restrict functionality or suspend accounts where we reasonably believe these rules have been violated.

15. Safety

Possibl is designed to facilitate connections between users and Service Providers.

However, interactions and services may occur between individuals or organizations that are independent of Possibl.

Users should exercise reasonable judgment and appropriate caution when:

  • Meeting another person
  • Booking a service
  • Visiting a studio or venue
  • Participating in an event
  • Sharing personal information
  • Making arrangements outside the Platform

Service Providers are responsible for maintaining appropriate safety standards for the services they provide.

Where a service involves children or vulnerable individuals, the Service Provider and responsible parent or guardian must ensure appropriate supervision, permissions and safeguards.

Possibl may take action against accounts or listings that present credible safety, fraud or abuse concerns.

16. Communications Between Users

Possibl may provide messaging, contact or communication functionality.

You agree to use such functionality responsibly and only for legitimate purposes related to the Platform.

You must not use Possibl communications to:

  • Harass or threaten another person
  • Send spam
  • Distribute malicious content
  • Conduct fraudulent activity
  • Collect personal information without authorization
  • Circumvent Platform policies or payment processes

Possibl may use automated systems or human review to detect abuse, fraud, spam or violations where permitted by applicable law and described in our Privacy Policy.

17. Recommendations, Search and Discovery

Possibl may use algorithms, ranking systems, personalization and other technologies to help users discover relevant talent, services, events and experiences.

Search results and recommendations may depend on factors including:

  • Search terms
  • Location
  • Availability
  • Service category
  • User preferences
  • Profile information
  • Engagement
  • Reviews and ratings
  • Relevance
  • Platform activity
  • Other operational or commercial factors

Possibl does not guarantee that search results or recommendations are complete, unbiased, error-free or suitable for every user.

18. Third-Party Services

Possibl may integrate with third-party services for functions such as:

  • Authentication
  • Payments
  • Analytics
  • Cloud hosting
  • Storage
  • Communications
  • Notifications
  • Maps and location services
  • Security
  • Customer support

Your use of third-party services may be subject to their separate terms and privacy policies.

Possibl is not responsible for the independent operation, availability or policies of third-party services.

19. Internet and Device Requirements

Possibl is an internet-based service.

Certain functionality requires an active internet connection, compatible browser, supported device, sufficient bandwidth and other technical requirements.

Possibl is not responsible for failures caused by:

  • Internet outages
  • Mobile network failures
  • Device failures
  • Browser incompatibility
  • Third-party infrastructure failures
  • Insufficient device storage
  • Battery failure
  • Unsupported software
  • Other circumstances outside our reasonable control

Standard mobile network, internet or other third-party charges may apply.

20. Availability and Changes to Possibl

We continually develop Possibl and may add, modify, suspend or discontinue features.

We may:

  • Change the design or functionality of the Platform
  • Introduce new features
  • Remove features
  • Change pricing or fees with appropriate notice where required
  • Modify discovery and recommendation systems
  • Introduce additional products or services
  • Temporarily suspend functionality for maintenance or security
  • Discontinue certain services

We will make reasonable efforts to communicate material changes where required.

We do not guarantee that every feature will always remain available.

21. Mobile Applications

At the time these Terms become effective, Possibl is primarily available through its web application.

Possibl may subsequently release applications for iOS, Android or other platforms.

When mobile applications become available, additional requirements may apply based on the relevant operating system and app store.

Your use of any Possibl mobile application may also be subject to the applicable Apple App Store, Google Play or other platform terms.

22. Privacy

Your use of Possibl is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and disclose personal information.

You can review the Privacy Policy through the privacy section of the Possibl Platform.

23. Disclaimers

Possibl provides the Platform on an “as available” and “as is” basis to the extent permitted by applicable law.

We make reasonable efforts to maintain accurate and useful information, but we do not guarantee that:

  • The Platform will always be available
  • The Platform will be uninterrupted or error-free
  • Information will always be complete or accurate
  • Profiles or listings will always be current
  • A particular Service Provider will be available
  • A booking will be accepted
  • A service will meet your expectations
  • A Service Provider will perform as represented
  • A particular result, opportunity or income will be achieved

Information provided through Possibl should not be treated as a guarantee, professional certification, endorsement or representation unless expressly stated.

24. Possibl's Relationship With Service Providers

Possibl does not automatically endorse or certify every Service Provider listed on the Platform.

The presence of a profile, ranking, review, badge or listing does not necessarily mean that Possibl guarantees or warrants the Service Provider's qualifications, quality or performance.

Where Possibl performs verification or provides badges or other trust indicators, those indicators describe only the specific verification performed and should not be interpreted as a comprehensive guarantee of the Service Provider.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Possibl and its owners, employees, contractors, affiliates and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from or related to your use of the Platform.

This may include losses relating to:

  • Service Provider conduct
  • User conduct
  • Cancellations
  • Missed bookings
  • Service quality
  • Injuries or incidents occurring during services
  • Loss of data
  • Business interruption
  • Loss of profits
  • Unauthorized access
  • Third-party services
  • Platform interruptions

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

26. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Possibl and its officers, employees, contractors, affiliates and representatives from claims, liabilities, losses, damages and expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Platform
  • Your User Content
  • Your services or activities as a Service Provider
  • Your violation of another person's rights
  • Your violation of applicable law
  • Your fraudulent or unauthorized activity

27. Account Suspension and Termination

Possibl may suspend, restrict or terminate access to an account where we reasonably believe that:

  • These Terms have been violated
  • Fraudulent or abusive activity has occurred
  • The account presents a security or safety risk
  • The account contains materially misleading information
  • The Platform is being misused
  • Required legal or regulatory obligations require action

Where reasonably appropriate, we may provide notice and an opportunity to resolve the issue.

We may also suspend functionality temporarily where necessary for security, maintenance, investigation or other legitimate operational reasons.

You may stop using Possibl at any time and may request account deletion in accordance with our Privacy Policy and applicable procedures.

28. Effect of Termination

Upon termination or closure of an account:

  • Your right to use the affected Platform functionality may end
  • Outstanding obligations may continue until resolved
  • Confirmed bookings may remain subject to their applicable cancellation and refund terms
  • Certain information may be retained where required or permitted by law
  • Provisions that by their nature should survive termination will continue to apply

29. Dispute Resolution

If you have a dispute or concern regarding Possibl, we encourage you to first contact us so that we can attempt to resolve the matter informally.

Nothing in these Terms is intended to prevent a consumer from exercising any rights or remedies available under applicable consumer protection laws.

Where legally permissible and appropriate, disputes may be subject to applicable Indian law and the jurisdiction of competent courts.

The final governing-law and jurisdiction clause should be reviewed and finalized by Possibl's legal counsel based on the company's registered entity and principal place of business before publication.

30. Changes to These Terms

We may update these Terms from time to time as Possibl evolves, new features are introduced or applicable laws and regulations change.

When we make material changes, we may provide notice through the Platform or other appropriate means where required.

The updated Terms will become effective from the date specified at the beginning of the revised Terms.

Your continued use of Possibl after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
